On Monday, the Supreme Court dismissed a plea by Aam Aadmi Party (AAP) leader Arvind Kejriwal, challenging a defamation case filed against him for questioning Prime Minister Narendra Modi's educational qualifications. The case relates to Kejriwal’s comments about the authenticity of the PM's degrees, particularly from Gujarat University, which the university claimed were defamatory.
The defamation case was filed by the Gujarat University’s registrar, Piyush Patel, accusing Kejriwal and AAP MP Sanjay Singh of making derogatory statements that harmed the university’s reputation. Kejriwal had approached the Supreme Court after the Gujarat High Court refused to quash the summons issued to him in the case.
A bench of Justices Hrishikesh Roy and SVN Bhatti dismissed Kejriwal’s petition, noting that the court had already rejected a similar plea by Sanjay Singh back in April. The court did not delve into the details of the case, but it maintained its consistent stance, as seen in Singh’s petition.
Kejriwal’s lawyer, senior advocate Abhishek Manu Singhvi, argued that the defamation case was part of a plan to get Kejriwal convicted and possibly disqualified from politics. However, Solicitor General Tushar Mehta, representing Gujarat University, referred to the earlier ruling in Singh’s case and criticized Kejriwal, claiming he frequently makes reckless statements and then apologizes, citing past incidents involving the late Arun Jaitley.
After listening to both sides, the court gave Singhvi a choice: proceed with the hearing, or withdraw the plea knowing that the court’s final decision would be based on the case's merits. Singhvi opted to withdraw, and the petition was dismissed.
